Cafform — Terms of Service

Acceptance of terms

These terms govern your use of cafform.com and every purchase you make from it. Cafform is the trading name of ELKADRI & CO LTD.

By placing an order through cafform.com, you agree to these Terms of Service. These terms and our other store policies are made available through our website and checkout before you place your order.

Nothing in these terms limits any consumer right or remedy that cannot lawfully be limited or excluded in the jurisdiction that applies to your purchase.

Eligibility and age

You must be at least 18 years old and able to enter into a binding contract to order from us.

We currently sell and deliver to customers with eligible delivery addresses in the 48 contiguous United States and Washington, DC, and Canada.

We do not currently ship to Alaska, Hawaii, Puerto Rico, Guam, the US Virgin Islands, PO boxes, or APO/FPO/DPO addresses.

Accounts

You can order without signing in, or use a customer account to view and manage your order information. Customer accounts may use Shopify's passwordless sign-in system.

You are responsible for keeping access to your email account secure. Tell us at support@cafform.com if you believe someone has gained unauthorised access to your customer account, and we will help secure it.

Pricing and price errors

Prices are displayed in the currency shown to you on the website and at checkout. Customers shopping from the United States will generally see prices in US dollars, while customers shopping from Canada may see prices in Canadian dollars.

The final price, currency, applicable taxes, shipping charge and any other amount collected by Cafform are shown at checkout before you confirm your order.

We may change prices at any time. The price that applies to an accepted order is the price shown when that order is placed, subject to the price-error provision below.

Occasionally a price may be published in error. Where a price is clearly and materially incorrect, we may decline the order rather than fulfil it at the erroneous price. If we do, we will notify you and refund any amount we collected for that order to the original payment method.

We will not ship an order at an erroneous price and later invoice you for an additional amount without your agreement.

Orders and order acceptance

Submitting an order sends us a request to purchase the products shown in your checkout. An order confirmation acknowledges that we received your order; it does not necessarily mean that we have accepted or dispatched it.

Unless applicable law requires otherwise, we accept your order when we dispatch it and send you shipment confirmation.

We may decline or cancel an order before shipment where, for example:

• the product is unavailable
• there is a clear pricing or listing error
• the delivery address cannot be served
• payment cannot be authorised
• we have reasonable grounds to suspect fraud or misuse

If we decline an order after taking payment, we refund the amount collected to the original payment method.

Payment methods

We accept the payment methods displayed to you at checkout, which may include major credit and debit cards, Apple Pay, Google Pay and Shop Pay.

Available payment methods may vary according to your location, currency and checkout configuration.

Charges from Cafform may appear on your statement as SP CAFFORM.

Taxes, duties and import charges

United States

Applicable sales tax is calculated according to the delivery address and our tax obligations and is shown at checkout where we are required to collect it.

Canada

Canadian orders may be subject to applicable federal or provincial taxes, customs duties, brokerage charges or other import-related charges.

Any tax, duty or import charge that Cafform collects will be shown at checkout before you place your order.

Where an applicable Canadian tax, duty, brokerage fee or import charge is not collected by Cafform at checkout, it may be assessed separately by the relevant authority, customs service or carrier.

Free shipping refers only to the standard shipping charge paid by Cafform. It does not by itself mean that government taxes, customs duties or import-related charges are waived.

Shipping and delivery

Standard shipping is free for eligible orders to the 48 contiguous United States and Washington, DC, and Canada.

Shipping destinations, processing times, estimated transit times, tracking information and delivery restrictions are described in our Shipping Policy.

Transfer of title and risk of loss

Subject to any mandatory law that applies to your purchase, title and risk of loss pass to you when the order is delivered to the delivery address you provided.

If tracking indicates delivery but you have not received the parcel, or if the parcel arrives damaged, contact us. We investigate these situations under our Shipping Policy and Refund and Return Policy.

A carrier delivery scan does not prevent you from contacting us or requesting an investigation.

Returns and refunds

Eligible coffee machines may be returned within 30 calendar days of delivery in accordance with our Refund and Return Policy.

Cafform provides a prepaid return shipping label at no cost for every eligible return covered by that policy, including eligible change-of-mind returns.

We charge no restocking fee.

Change-of-mind returns remain subject to the product-condition requirements described in our Refund and Return Policy.

The Cafform 2-Year Limited Warranty

This is a 2-Year Limited Warranty provided by Cafform, the trading name of ELKADRI & CO LTD. Cafform is the warrantor and bears the cost of performing its obligations under this warranty.

Duration: 2 years from the date your machine is delivered.

What it covers:

• pump failure
• boiler and heating element defects
• electrical component defects
• manufacturing faults

What it does not cover:

• limescale or scale damage caused by hard water or inadequate maintenance
• normal wear and tear
• commercial use of a machine sold for domestic use where that commercial use caused or contributed to the failure
• damage caused by accident, misuse, neglect or failure to follow the operating instructions
• damage or defects caused by an improper repair, modification, part or service not provided by Cafform
• consumable parts that have reached the end of their normal service life, including gaskets, filters and shower screens

The fact that a machine has been repaired, serviced or fitted with a part by someone other than Cafform does not by itself cancel this warranty. However, this warranty does not cover damage or a defect caused by an improper third-party repair, modification, part or service.

How to claim: email support@cafform.com with your order number and a description of the fault. We will review the claim, provide instructions and, where a return is required, arrange return shipping at our cost.

For a covered claim, Cafform will provide the remedy described to you for that claim, which may include repair, replacement or refund as appropriate and as required by applicable law.

Who it covers: the Cafform 2-Year Limited Warranty is provided to the original purchaser, subject to any rights that applicable law gives to another lawful owner or consumer.

The warranty terms are made available before purchase on cafform.com.

Implied warranties and statutory rights

The Cafform 2-Year Limited Warranty is additional to, and does not replace, consumer rights that arise automatically under applicable law.

For purchases in the United States, Cafform does not disclaim implied warranties that cannot lawfully be disclaimed while we provide this written 2-Year Limited Warranty.

To the extent permitted by applicable law, any implied warranty whose duration may lawfully be limited may be limited to the 2-year duration of the Cafform 2-Year Limited Warranty. Where applicable law does not allow such a limitation, that limitation does not apply.

For purchases in Canada, nothing in the Cafform 2-Year Limited Warranty or these Terms of Service excludes, restricts or replaces any mandatory warranty, quality, durability, fitness, contractual or consumer-protection right that applies under federal, provincial or territorial law.

Limitation of liability

To the extent permitted by applicable law, Cafform is not responsible for indirect, incidental or consequential losses that were not reasonably foreseeable when the order was placed.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer remedies.

Nothing in this section removes or reduces your rights under our Refund and Return Policy, the Cafform 2-Year Limited Warranty, or applicable consumer law.

Use of the website

You may use cafform.com only for lawful purposes.

You must not intentionally interfere with the operation or security of the website, attempt unauthorised access, misuse another person's account, or use the website in a fraudulent manner.

Intellectual property

The Cafform name, our original site design, photography and written content belong to ELKADRI & CO LTD or are used by us under applicable rights or permissions.

Manufacturer names, product names, trademarks and other third-party materials belong to their respective owners and are used to identify the products we sell.

You may not reproduce or commercially exploit Cafform-owned content without permission except where applicable law permits it.

Force majeure and events outside our control

If an event outside our reasonable control prevents or materially delays fulfilment — for example severe weather, natural disaster, carrier network disruption, government action or a similar event — we will take reasonable steps to reduce the effect of the disruption and provide you with updated information where appropriate.

If a significant delay occurs before shipment, you may contact us to discuss continuing with or cancelling the order. Mandatory cancellation or refund rights provided by applicable law remain unaffected.

Dispute resolution

If something goes wrong, contact us first at support@cafform.com. We will try to resolve the issue directly.

These terms do not require mandatory arbitration and do not waive any right you may have to participate in a class or collective proceeding where such a right cannot lawfully be waived.

Nothing in these terms prevents you from contacting or filing a complaint with an applicable consumer protection, regulatory or government authority.

Applicable consumer rights

These terms do not select a governing law or forum in a way intended to deprive a consumer of mandatory protections that otherwise apply to the transaction.

For customers in the United States, applicable federal and state consumer-protection and warranty rights remain in effect.

For customers in Canada, applicable federal, provincial and territorial consumer-protection rights remain in effect.

If any provision of these terms conflicts with a mandatory consumer-protection rule that applies to your purchase, the mandatory rule applies to the extent of that conflict.

Changes to these terms

We may update these terms from time to time. The version applicable when you place an order governs that order unless applicable law requires otherwise.

Changes do not retroactively reduce rights attached to an order that was already placed.

Each version includes a version number and effective date at the top of this page.
